Is online gambling legal in the United States?
There is no single national answer. Federal law sets a backdrop, including the Unlawful Internet Gambling Enforcement Act and a 2011 Department of Justice opinion that the Wire Act applies only to sports betting. The 2018 Supreme Court decision that struck down the federal sports betting ban left each state to decide whether to authorise sports betting. States decide separately about online casino games.

Which states allow online casino games?

Online or mobile sports betting is available in many of them, including Arizona, Arkansas, Colorado, Connecticut, Delaware, D.C., Florida, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Missouri, Nevada, New Hampshire, New Jersey, New York, North Carolina, Ohio, Oregon, Pennsylvania, Rhode Island, Tennessee, Vermont, Virginia, West Virginia and Wyoming.
This list needs checking against current state regulator pages, because launch dates, retail-only status and referendums (for example, Alabama's reported November 2026 vote) change frequently.
Regulators, age, tax and player protection
Each state has its own regulator, for example the New Jersey Division of Gaming Enforcement, the Pennsylvania Gaming Control Board, the Michigan Gaming Control Board and state lotteries in some states. The minimum age is 21 in most states for online casino and sports betting, with some states allowing 18, so check your state.
Players generally owe federal income tax on gambling winnings, and state tax may also apply. Operators pay state taxes at widely differing rates. Most regulated states offer self-exclusion programs, and licensed operators must verify location, age and identity.
