Is online gambling legal in Australia?
It depends on the product. The Interactive Gambling Act 2001 (IGA) makes it an offence to provide online casino games, including online slots and table games, to people in Australia. Online poker is similarly outside the law. Licensed online wagering on sports and racing, lotteries and some other products are permitted, with licences granted by state and territory regulators.
The Australian Communications and Media Authority (ACMA, acma.gov.au) enforces the IGA, runs a website-blocking regime for illegal services and has warned that promoting illegal gambling, including by influencers, may be unlawful. Players are not prosecuted under the IGA for using offshore sites, but those sites have no Australian licence or consumer protection.
Licensing, BetStop and player protection
Licensed wagering operators hold state or territory licences and must also comply with federal rules.
- BetStop: the National Self-Exclusion Register for online and phone wagering, with exclusion periods from three months to permanent.
- Credit ban: licensed online wagering providers may not accept credit cards or credit-related payment methods, with some carve-outs for lotteries and keno that have been criticised.

The 2026 advertising and inducement reforms
The Interactive Gambling Amendment (Gambling Reform) Bill 2026 passed Parliament on 19 August 2026. Reported measures include:
- A limit of three wagering ads per hour on broadcast TV between 5am and 8:30pm, plus a ban on wagering ads during live sport broadcasts in that window.
- A "triple lock" for online platforms: wagering ads only to logged-in users aged 18 or over who have not opted out, with platforms required to comply by 1 January 2027 or stop showing wagering ads in Australia.
- A national AdStop opt-out register run by the ACMA, expected to take about 12 months to build.
- Limits on direct marketing of inducements: banned for 14 days after sign-up, for three months after someone deregisters from BetStop, and entirely for customers identified as at risk.
- Powers for banks and payment systems to block transactions to illegal operators, and a ban on online keno "pocket pokies" and foreign-matched lotteries.

Tax, payments and popular products
Recreational players do not pay tax on gambling winnings in Australia. Operators pay state and territory wagering taxes and federal levies, including new cost-recovery levies to fund BetStop and the new inducement rules.
