Online casinos and sports betting are legal in Spain with a licence from the Dirección General de Ordenación del Juego (DGOJ). Is online gambling legal in Spain?
Yes. Gambling Act 13/2011 created a licensed national market for online sports betting, casino games, poker, bingo and contests. Operators need a general licence and a singular licence for each game type, issued by the DGOJ (ordenacionjuego.es), which sits within the Ministry of Consumer Affairs. Companies cannot lawfully offer games to Spanish residents without these licences.
New general licences are not currently being tendered, so newcomers often enter by acquiring a company that already holds one. The market is large: the DGOJ reported €454.1 million of gross gaming revenue from regulated online gambling in the first quarter of 2026, up 13.9% year on year. Regional gambling laws can add rules for land-based venues, but online licensing is national.
DGOJ licensing and player protection
Licensed operators must verify identity and age before a player can deposit or play, and must apply the protections set out in the player-protection royal decree.
- Minimum age: 18.
- Self-exclusion: the Registro General de Interdicciones de Acceso al Juego (RGIAJ) bars you from every licensed operator.
- Shared deposit limits: approved by royal decree on 23 June 2026. Reported default limits are €700 per day, €1,750 per week and €3,300 per four weeks across all operators, replacing per-operator limits of €600, €1,500 and €3,000. Players can modify them through a safeguarded procedure. Exact dates of application depend on the DGOJ building its central control tool.

Tax on operators and on player winnings
Operators pay 20% of gross gaming revenue on online gambling, with a reduced 10% rate for operators established in Ceuta and Melilla, according to legal commentary. Several operators have relocated there for that reason.
Unlike in some countries, gambling prizes can count as taxable income for players under Spanish personal income tax rules, and rules differ by prize type and amount. Players should check the Agencia Tributaria or a tax adviser rather than assume winnings are tax-free.
Games, payments, bonuses and advertising
Football betting and online slots are the main products, with roulette, blackjack, live casino and poker also popular. Players typically pay by card, bank transfer, Bizum-style mobile payments and e-wallets.
Advertising is among the strictest in Europe. A 2020 royal decree sharply limited gambling ads and welcome bonuses, although the Supreme Court annulled parts of it. In May 2026 the DGOJ opened a consultation on a broader reform of Law 13/2011, covering celebrity and influencer endorsements, sign-up bonuses and a registry of gambling suppliers. The consultation closed on 22 June 2026, and the outcome could tighten rules further.
